Armed Burglary Stopped in the Act by Utica Police

On May 24th, 2024 at approximately 6:00 PM Utica Police units were dispatched to a residence on the 1000 block of Mohawk St regarding a possible burglary/trespass investigation.

Upon arrival, they spoke with the caller who stated that a male whom she was familiar with had made entry into her residence and was currently in a back hallway. The officers then went to the location and noticed the male described. At this point, they further noticed that he was wearing a bag around his chest. As the male saw the police coming, he retreated back into the hallway and discarded the bag. After some moments he came back out without the bag and was detained for the investigation.

As the officers inspected the bag, they were able to feel what they believed to be a handgun inside. Upon further investigation, they found the weapon to be a loaded 9mm handgun.

At that point, the male was transported to the Utica Police Department, and at the conclusion of the investigation, Timothy Cubbage age 34 of Utica was charged with:

Criminal Possession of a Weapon in the second degree

Criminal Possession of a Weapon in the Third Degree x2 (Previous Conviction, extended magazine)

Criminal Possession of a Firearm.
